Many people ask, “what do I do if I’m pulled over and the police suspect me of Driving While Intoxicated?” That depends! Ohio Law allows for increased penalties if you refuse to take tests. However, it is still frightening to think you may be arrested for driving while intoxicated. Police are authorized to investigate if they have reasonable suspicion that you are, or are committing a crime. Most DUI stops begin with a traffic violation, such as marked lanes, speed, turn signal, or even failing to have a light on your license plate. Police are allowed to ask for your identification, proof of insurance and proof of vehicle ownership. While they are doing this, they can smell, look and listen to everything around you and your vehicle. So beware, if police smell alcohol, see blood shot eyes or hear someone slur their speech, they can ask you out of your vehicle to expand their search and add to probable cause to arrest you.
